- From the author We have seen in the preceding chapter how the courts and text-writers oscillate back and forth between calling the patent right a monopoly and denying that it is one. This is a long way from explaining what the patent right is, in view of the matter is further complicated by the ambiguity of the language of the patent grant itself.
